Hey!
I went to a Flea-Market today, and for the second time, I became udderly enraged! I saw not one, but two different stands selling RES hatchlings. I ask the person selling them if they knew it was illegal to sell a turtle under 4 inches. They said it was ok, since they were liscensed, and got their's from hatcheries. At that point, I backed down, but I would really like to know if she was feeding me a line of B.S. or if that is true. Either way, I would love to find some proof supporting whatever is correct.
After I had made my statement about her illegal practices, she went on and started talking to someone else. This customer asked the infamous question "Will they get any bigger?". Her response, "No, if you keep them in a small environment, such as this Turtle Lagoon we have, they won't grow much." Before even thinking, I said "Well, they won't live very long in those d@mn death bowls!" I soon walked away.
Anyhow, the purpose of my post is this:
1) Is it legal to sell a RES hatchling if you have the proper liscensing and you get them from a hatchery?
2) Where can I find information proving or disproving this?

P.S. I am from Kentucky and I was at an Ohio Flea-Market. Could the laws be different? I thought it was a natoin-wide thing that selling turtles under 4 inches was illegal.

I don't know (being from the UK), but I thought it was illegal everywhere - report her to your local trading standards dept or animal rights group, they will be able to investigate.

It was my impression, that even with a licence, you can still only sell to or for that education or scientific purposes......it is illegal for turtles to be sold as pets, under 4".
You should protest him.....seriously....hand out real caresheets to those you see buying from him, report him call the flea market owners....citing animal cruelty, threaten media and or legal stuff.
Man I woulda had a field day on his butt. lol.
As for proving, USA, go to their govt website, look for who ever is responsible for animals. In Ontario that is Ministry of Natural Resources. Contact humane socieeties adn local turtle adoption/fighter type places in that area or your area and see what they can do.

Jinx, you helped a lot! I'll look into that. I would have started to protest that very day, but I wanted to check it out with my turtle pals. I would feel really bad if I protested them, and what they were doing turned out to be legal. I told my mom that if I had extra money, I'd rent the place across from the turtle killers and hand out proper information. I'll check on some of those sites!

...Wow, I havent been here in forever... Anyways, It is illegal in I think every US State to sell turtles under 4 inches. In my opinion that law is pointless, it was made to prevent small children from getting small turtles and putting them in their mouths, and contracting salmonealisis (sp*?) also known as salmonela. Truthfully, Ive bought every turtle at about 6 total I believe, from hatchery wholesale people at no bigger than a half-dollar. And Ive caught about 4 others and hatched and raised to about 3inches a large clutch of softshells. So the whole law thing I think is bogus. Also every softy I hatched I released within a week as I only hatched them to prevent them from being dug up and destroyed by the local golf course who isnt very found of large dirt patches near the water. Hope some of my rambling helped.

You're right about the salmonella. The salmonella was a big issue, in addition to what you said, because the bulk of the turtles were captivated and therfore carrying loads of bacteria. That compunded with the fact that they were housed in Death Bowls (which if you see the www.turtlesale com ad up there at the top, they sell them.. *cough*boycott*cough* ) and without filters and people not washing their hands, of course there were going to be problems. The law was useful at the time, emphasis on 'was'. Now that the facts are know and information is readily acceptable, the law is simply archaic. No, I am not finished yet.. lol On teh other hand, if the law prevents some people from selling endangered baby turtles, then I would consider that to be a small little victory in the fight to save the turtles. Oh and Jinx you are right; if they are sold for "scientific, educational, or exhibitional" purposes, then the sale is legal. But since turtles are in a sense on display in your home, are they not being exhibited..? Hmm.. [glow=blue,2,300]:Chez[/glow]

In order for something to be considered on exhibition, (as used in the 4inch law) means money must be exchanged in the form of admissions, for it to count as exhibition and not pets. It is not meant in its literal sense.

really i think the 4 inch law is RETARDED IN A HALF.. i mean come on. u shouldnt even own an animal if u cant clean ur hands after u handle them.. and i've heard ppl got salmonella from puttin the turtles in their mouth!? HOLY RETARDS... and u can get it from a turtle above 4 inches too.. i own 2 turtles so far that are under 4'' and i'm not dumb with them.. i kno what i can and cannot due.. lol..but i mean.. its teriible that ppl sell them.. when they kno ZERO facts about them.. when i walk into pet stores with turtle lagoons..i just yell BS in the store really loud.. its quite fun.. or i hide all of them somewhere..lol.. my life is great...

Does that work for You ... yelling BS and hiding things in the store.
Do they change their policies, do other customers see and understand what you are doing and maybe boycott with You, do You yourself just go in and hid things and whatnot or do you shop their too, has anything positive come from yelling and hiding things??

PS Turtledude ... another thing You could try is contact the management of the flea market and complain or state your case to them and see what happens.

Hey guys, im out of my hiding... im still pissed about the turtle thing, but we havent been back to the flee market, so i havent been able to have my fun...and now its cold, so the dumbasses are probably done until spring...but i have my liscense now and i dont have to rely on my parents to get me places, so i may go up there one day and have some fun!
